Welcome to CampUs Vitali!

CampUs Vitali (“CampUs,” “CUV”, “Education Center” “we,” “us,” “our”) provides its services and or products (described below) to you through its website located at www.CampUsVitali.com (the “Site”) and face-to-face at education centers which subject to the following Terms of Service (as amended from time to time, the “Terms of Service”). CampUs Vitali™ reserves the right to change, alter, or modify policies from time to time (for example but not limited to, if the law changes) and will be reviewed annually and on an as-needed basis. Updates will be posted on this page and will indicate at the top of this page the date on which these terms were last revised. Changes will be immediately posted on our Site, and you will be deemed to have accepted the terms of the updated policy(ies) on your first use of our Site/ Service following the alterations. Your continued use of the Site/ Service after the date any such changes become effective constitutes your acceptance of the new Terms of Service. We recommend that you check this and all pages regularly to keep up to date.

Please read these Terms of Service carefully, as they contain an agreement to adjudicate and other important information regarding your legal rights, remedies, and obligations.

When using certain aspects of the Services or using certain Services, you will be subject to any additional terms applicable to such services that may be posted on the Service from time to time, including, without limitation, our Privacy Policy, Community Standards, Refund Policy, and Digital Citizenship Rules. All such terms are hereby incorporated by reference into these Terms of Service.

The Services consist of an online and face-to-face 501(c)3 education center (PSP) and platform through which Educators (Tutors, Consultants, and Educational Coaches) may offer Courses for sale to Learners, Families, Educators, Parents, and Professionals may purchase such services (tutoring, professional development, and educator). While CampUs Vitali strives to high standard of service, you acknowledge and agree that: (1) CampUs Vitali only provides certain tools to facilitate the purchase, sale, and provision of Courses, (2) Courses are contracted directly with Educators, Tutors, Consultants and Educational Coaches (3) CampUs Vitali is not a broker, agent (except as expressly set forth below) or insurer, and (4) CampUs Vitali disclaims all liability for the conduct of Tutors, Educational Coaches, Parents, or any other Users of the Site and or Service or Courses. Different sections of the Site and or Service and Terms of Service affect Tutors, Educators, Teachers, Learners, Families, and Parents differently, so please be sure to read these Terms of Service carefully.


Key Terms

“User” “you” or “your” means a person, organization, or entity using the Site/ Services, including Parents, Families, Learners, Educators, Tutors, Consultants, Teachers, and Educational Coaches.

“Client(s)” means a parent, legal guardian, family, educator, teacher, learner, or professional who completes CampUs Vitali’s account registration process to purchase services on the Site for online or face-to-face purposes.

“Educator(s)” means a person(s) who completes CampUs Vitali’s registration process to offer courses on the Site online or face-to-face, or an educational coach who executes an agreement with CampUs Vitali to sell Courses on the Site.

“Service(s)” means any online or face-to-face service(s) provided by Educators (Tutors, Consultants, and Educational Coaches) for sale.

“Product(s)” means any online or face-to-face product(s) provided by Educators (Tutors, Consultants, and Educational Coaches) for sale.

 

Access and Use of the Service

Services and Products Description: CampUs Vitali is an online and face-to-face 501(c)3 education center (PSP) for learners, parents, families, educators, and professionals. We cater to K-16; Pre-K only with parental involvement online and or face-to-face; essentially all members of the family.  Our Site and or Service is designed for our clients to find and book these Sessions for the benefit of improving their education experiences, and for Educators, Home Educating Parents and Otherwise,  Teachers, and other Professionals to grow professionally and personally by booking Professional/ Personal Development services and workshops.

Your Registration Obligations: You will be required to register with CampUs Vitali in order to access and use our Services and or Products. If you choose to register for the Service and or Products, you agree to provide and maintain true, accurate, current, and complete information about yourself as prompted by the Site and or Service’s registration form. Registration data and certain other information about you are governed by our Privacy Policy. You must be of legal age to form a binding contract to register for the Service (in many jurisdictions, this age is 18). If you are not yet of legal age to form a binding contract, then you must get your Parent/ Guardian/ Caregiver to read these Terms of Service and agree to them for you before you use the Service and or Product. If you are a Parent and you provide your consent to your child’s use of the Service and or Product, then you agree to be bound by these Terms of Service with respect to your child’s use of the Service and or Product.

Member Account, Password, and Security: You are responsible for maintaining the confidentiality of your password and account, if any, and are fully responsible for any and all activities that occur under your password or account. You agree to (a) immediately notify CampUs Vitali of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session when accessing the Site and or Service. CampUs Vitali will not be liable for any loss or damage arising from your failure to comply with this Section.

Modifications to Service and or Product: CampUs Vitali reserves the right to modify or discontinue, temporarily or permanently, the Service and or Product (or any part thereof) with or without notice. You agree that CampUs Vitali will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service and or Product.

General Practices Regarding Use and Storage: You acknowledge that CampUs Vitali may establish general practices and limits concerning use of the Site and or Service, including without limitation the maximum period of time that data or other content will be retained by the Site and the maximum storage space that will be allotted on CampUs Vitali’s servers on your behalf. You agree that CampUs Vitali has no responsibility or liability for the deletion or failure to store any data or other content maintained or uploaded by or to the Site and or Service. You acknowledge that CampUs Vitali reserves the right to terminate accounts that are inactive for an extended period of time. You further acknowledge that CampUs Vitali reserves the right to change these general practices and limits at any time, in its sole discretion, with or without notice.

Session Recordings: Courses that take place through CampUs Vitali’s video chat platform are automatically recorded by CampUs Vitali (“Course/Session Recordings”). We value clients' and educators’ privacy, and our use of Recordings is extremely limited. Specifically, Course/Session Recordings are made available only to the Educator, Clients, and CUV Administrators participating or having oversight for the Course in question, in order to allow them to (1) provide a viewable copy to learners who missed a Session, or who wish to review the Session, for their personal educational purposes; and (2) review the Recording personally in order to improve their Courses. In addition, CampUs Vitali may use Recordings to provide feedback to Educators, to improve our Services, for Advertisement, for Customer Support, compliance purposes, and otherwise. CampUs Vitali retains Course Recordings for as long as it is deemed appropriate after the date of the relevant Course is completed by all relevant parties, subject to our Privacy Policy, after which they are deleted. Notwithstanding the foregoing, CampUs Vitali will also delete Course Recordings earlier than six months under the following circumstances: (a) upon the request of a client for the deletion of their personally identifiable information, or (b) upon the reasonable determination of CampUs Vitali that a Course Recording should be removed to protect the privacy of certain Users or because of violations of these Terms of Service. We will use Course Recordings containing images of our clients for promotional purposes. By using the services, you consent to you and/or your child appearing in Course Recordings for the purposes set forth above.

 

Certain Educator Obligations 

Education Center Basics: As an Educator, you must provide CampUs Vitali with any information requested for CampUs Vitali to hire you and for you to be booked for courses, sessions, consultations, tutoring, and otherwise. CampUs Vitali has sole discretion as to which Educators are accepted into the online and face-to-face 501(c)(3) education center (PSP) and we reserve the right to reject any potential Educator and remove or suspend any Educator from the education center for any reason. CampUs Vitali may, but is not required to, conduct background checks on and interviews of Educators at its discretion and solely for its own benefit. As an Educator, you agree to provide written and/or electronic consent to such background checks and to participate truthfully in such interviews.

Community Standards: When you join the CampUs Vitali community, you agree to follow our policies, including our Community Standards, Guide Books and otherwise. Those expectations include thoughtful and professional communications with our community (colleagues, parents, children, and otherwise), modeling appropriate behavior for our learners, being on time, and acting professionally. In addition, you agree to use CampUs platforms, social media, blogs, and other online forums, appropriately. Inappropriate behavior in any CampUs Vitali affiliated online and face-to-face forum includes but is not limited to behavior intended to provoke, bully, demean, or cause harm to others, or to create conflict; or any other posts or content that CampUs Vitali, in its discretion, believes to be unconducive to a respectful and welcoming community for all. Inappropriate behavior in any  on-line and face-to-face forum includes, but is not limited to: posting on-line or speaking to the media on CampUs Vitali’s behalf without prior written authorization from CampUs Vitali; posts that CampUs Vitali, in its discretion, finds to be offensive or inappropriate based on race, sex, age, gender, sexual orientation, gender identity or expression, national origin, disability or medical condition, veteran status, or any other legally protected characteristic; derogatory, disparaging, or disrespectful comments about learners, teachers, educators, consultants, families, parents, affiliates or CampUs Vitali team, even if the target is not identified by name; sharing any private material, communication, or information regarding parents of learners, including but not limited to learners’ or parents’ names, photos, conversations, emails, learner educational abilities, aptitude or performance information, screenshots of learner work, or any other personal identifying information; posts that may be harmful to CampUs Vitali’s ongoing operations; sharing content that contains or promotes hate speech, threats of violence, or the endangerment of children; and any other violation of CampUs Vitali’s community standards.

Educator Responsibilities: Each Educator is solely responsible for obtaining all licenses and other permissions required to offer or provide any Service and or Product, and CampUs Vitali assumes no responsibility for an Educator’s failure to obtain such licenses or permissions or otherwise comply with any applicable laws, rules or regulations.

You understand and agree that CampUs Vitali is not an insurer for you as an Educator. If a Parent, Family, Learner, Educator, Consultant, Teacher, or Professional books any of your Courses, Sessions, Tutelage, or Otherwise, any agreement you enter into with such Parent, Family, Learner, Educator, Consultant, Teacher or Professional is between you and the Parent, Family, Learner, Educator, Consultant, Teacher or Professional, and CampUs Vitali is not a party thereto. Notwithstanding the foregoing, CampUs Vitali is authorized to serve as your limited agent purely for the purpose of accepting payments from Clients on your behalf and transmitting such payments to you (minus our Fees). You acknowledge and agree that, as an Educator, you are responsible for your own acts and omissions while using the Site and or Service. With the sole exception of learners enrolled in the applicable Courses, Sessions, Tutelage, and/or their Parents/Families, you further agree that you will not share any Recordings made available to you by CampUs Vitali to any third parties.

To the extent that you are using the Site and or Service as an Educator, you agree to abide by the terms of our Independent Contractor Agreement.

 

Payment Terms

General: Each User (Parent, Family, Learner, Educator, Consultant, Teacher,  Professional, and Otherwise) agrees to pay all applicable fees for services and or products (“Enrollment Fees”) as set forth on the Site and or Service. All Enrollment Fees are payable in the currency specified on the Site and or Service at the time of purchase. Taxes are added to each Service Fee. Users hereby authorize CampUs Vitali to bill the User’s payment instrument upon confirmation of purchase, and Users further agree to pay any charges so incurred. If a User needs to dispute any charges you can refer to our Refund Policy.

Educator Payment: CampUs Vitali will transfer the Enrollment Fees to the Educator’s bank account for each sale of a Course, Session, Tutelage (or set of Courses, as applicable) to a Parent,  Family, Individual or Otherwise within a reasonable period of time, minus CampUs Vitali’s service fees (“CampUs Vitali Fee”), according to the schedule and policies detailed in our  Independent Contractor Agreement. In order to transfer funds to the Educator's bank account. CampUs Vitali has the discretion to act on behalf of the client, and to not transfer the Service and or Product Fees to the Educator if clients report that the Course, Session, Tutelage (or set of Courses, as applicable) was not provided or adequately completed. This may include but is not limited to circumstances where an Educator did not arrive in a timely manner or at all for a Course, Session, Tutelage (or set of Courses, as applicable) or offered insufficient quality for the same. CampUs Vitali will independently review such cases, seeking input from the Client or Parent (if the Client is under 18 years of age) and/or the Educator, and may decide at its sole discretion to issue a refund to the Client or reschedule the session. All determinations of CampUs Vitali with respect to a refund or rescheduling a session shall be final and binding on the Client and Educator.

 

Conditions of Use

 User Conduct: You are solely responsible for all code, video, images, information, data, text, software, music, sound, photographs, graphics, messages, or other materials (“content”) that you upload, post, publish, or display (hereinafter, “upload”) or email or otherwise use via the Site/ Service. CampUs Vitali reserves the right to investigate and take appropriate legal action against anyone who, in CampUs Vitali’s sole discretion, violates this provision, including without limitation, removing the offending content from the Service, suspending or terminating the account of such violators and reporting you to the law enforcement authorities. The following are examples of the kind of content and/ or use that is illegal or prohibited by CampUs Vitali. You agree to not use the Service to:

email or otherwise upload any content that (i) infringes any intellectual property or other proprietary rights of any party; (ii) you do not have a right to upload under any law or under contractual or fiduciary relationships; (iii) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; (iv) poses or creates a privacy or security risk to any person; (v) constitutes unsolicited or unauthorized advertising, promotional materials, commercial activities and/or sales, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” “contests,” “sweepstakes,” or any other form of solicitation; (vi) is unlawful, harmful, threatening, abusive, harassing, tortious, excessively violent, defamatory, vulgar, obscene, pornographic, libelous, invasive of another’s privacy, hateful racially, ethnically or otherwise objectionable; or (vii) in the sole judgment of CampUs Vitali, is objectionable or which restricts or inhibits any other person from using or enjoying the Service, or which may expose CampUs Vitali or its users to any harm or liability of any type;

  • Interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies, or regulations of networks connected to the Service; or violate any applicable local, state, national, or international law, or any regulations having the force of law;
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity; solicit personal information from anyone in violation of our Privacy Policy;
  • Harvest or collect email addresses or other contact information of other users from the service by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications;
  • Advertise or offer to sell or buy any goods or services for any business purpose that is not specifically authorized;
  • Further or promote any criminal activity or enterprise or provide instructional information about illegal activities; or
  • Obtain or attempt to access or otherwise obtain any materials or information through any means not intentionally made available or provided for through the Service.

Special Notice for International Use; Commercial Use: Unless otherwise expressly authorized herein or in the Service, you agree not to display, distribute, license, perform, publish, reproduce, duplicate, copy, create derivative works from, modify, sell, resell, exploit, transfer or upload for any commercial purposes, any portion of the Service, use of the Service, or access to the Service.

Learners are expected to be on time and prepared for courses/ sessions/ activities. If learner is unable to attend any given session and no communication was forthcoming to make alternative arrangements, session will not be forwarded to another period. Nor, will the modality be modified in such a way that it may affect other learners. If for any reason the Educator is unable to attend a session, a make-up session will be arranged with the Educator and Learners. If for any reason any Learner has any concern or unusual circumstances it is the responsibility of same to present the situation to the administrator/ managers, in a timely manner; to resolve.


Intellectual Property Rights

 Service Content, Software, and Trademarks: You acknowledge and agree that the Service may contain content or features (“Service Content”) that are protected by copyright, patent, trademark, trade secret, or other proprietary rights and laws. Except as expressly authorized by CampUs Vitali, you agree not to modify, copy, frame, scrape, rent, lease, loan, sell, distribute, or create derivative works based on the Service or the Service Content, in whole or in part, except that the foregoing does not apply to your own User Content (as defined below) that you legally upload to the Service. For the sake of clarity, you acknowledge and agree that Class Recordings constitute Service Content, not User Content. In connection with your use of the Service, you will not engage in or use any data mining, robots, scraping, or similar data gathering or extraction methods. If you are blocked by CampUs Vitali from accessing the Service (including by blocking your IP address), you agree not to implement any measures to circumvent such blocking (e.g., by masking your IP address or using a proxy IP address). Any use of the Service or the Service Content other than as specifically authorized herein is strictly prohibited. The technology and software underlying the Service or distributed in connection therewith are the property of CampUs Vitali, our affiliates, and our partners (the “Software”). You agree not to copy, modify, create a derivative work of, reverse engineer, reverse assemble, or otherwise attempt to discover any source code, sell, assign, sublicense, or otherwise transfer any right in the Software. Any rights not expressly granted herein are reserved by CampUs Vitali.

The CampUs Vitali name and logos are trademarks and service marks of CampUs Vitali (collectively the “CampUs Vitali Trademarks”). Other CampUs Vitali, product, and service names and logos used and displayed via the Service may be trademarks or service marks of their respective owners who may or may not endorse or be affiliated with or connected to CampUs Vitali. `You should not interpret anything in these Terms of Service or the Service to mean that CampUs Vitali is in any way explicitly or implicitly giving you any license or right to use any of CampUs Vitali Trademarks displayed on the Service, without our prior written permission in each instance. All goodwill generated from the use of CampUs Vitali Trademarks is only for CampUs Vitali’s exclusive benefit.

Third-Party Material: Under no circumstances will CampUs Vitali be liable in any way for any content or materials of any third parties (including users), including, but not limited to, for any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of the use of any such content. CampUs Vitali and its designees will have the right to remove any content that violates these Terms of Service or is deemed by CampUs Vitali, in its sole discretion, to be otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any content, including any reliance on the accuracy, completeness, or usefulness of such content.

User Content Transmitted Through the Service: You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, or other information about the Service (“Submissions”), provided by you to CampUs Vitali are non-confidential and CampUs Vitali will be entitled to the unrestricted use and dissemination of these Submissions for any purpose, commercial or otherwise, without acknowledgment or compensation to you.

You acknowledge and agree that CampUs Vitali may preserve content and may also disclose content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process, applicable laws or government requests; (b) enforce these Terms of Service; (c) respond to claims that any content violates the rights of third parties; or (d) protect the rights, property, or personal safety of CampUs Vitali, its users and the public. You understand that the technical processing and transmission of the Service, including your content, may involve (a) transmissions over various networks; and (b) changes to conform and adapt to the technical requirements of connecting networks or devices.


Third-Party Websites

The Service may provide, or third parties may provide, links or other access to other sites and resources on the Internet. CampUs Vitali has no control over such sites and resources and CampUs Vitali is not responsible for and does not endorse such sites and resources. You further acknowledge and agree that CampUs Vitali will not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, events, goods or services available on or through any such site or resource. Any dealings you have with third parties found while using the Service are between you and the third party, and you agree that CampUs Vitali is not liable for any loss or claim that you may have against any such third party.

 

Indemnity and Release

You agree and understand that injuries and damages can occur by natural causes or by the acts of other persons or third parties, either as a result of negligence or because of other reasons. You are personally responsible for all costs and/or risks associated with any and all public or private activity. Notwithstanding anything to the contrary herein, to the fullest extent allowed by law, you agree to waive, discharge claims, release CampUs Vitali (TM) and all its organizers, hosts, subsidiaries, affiliates, officers, agents, volunteers, other partners, employees and otherwise, (collectively, “Indemnitees”) from all liability and indemnify and hold harmless CampUs Vitali (TM) and all Indemnitees from all liability on account of, or in any way resulting from injuries and damages in any way connected with any and all activities. You agree and understand and intend that this assumption of risk and release be binding upon you and your heirs, executors, agents, administrators and assigns, including any accompanying persons with participant(s) for any and all activities. 

 

Disclaimer of Warranties

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. CampUs Vitali EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

CampUs Vitali MAKES NO WARRANTY THAT (I) THE SERVICE WILL MEET YOUR REQUIREMENTS, (II) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (III) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, OR (IV) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS.


Limitation of Liability

You expressly understand and agree that CampUs Vitali will not be liable for any indirect, incidental, special, consequential, exemplary damages, or damages for loss of profits including but not limited to, damages for loss of goodwill, use, data, or other intangible losses (even if CampUs Vitali has been advised of the possibility of such damages), whether based on contract, tort, negligence, strict liability or otherwise, resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; or (v) any other matter relating to the service.

Some jurisdictions do not allow the disclaimer or exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the limitations set forth above may not apply to you or be enforceable with respect to you. If you are dissatisfied with any portion of the service or with these terms of service, your sole and exclusive remedy is to discontinue use of the service.


Termination

You agree that CampUs Vitali, in its sole discretion, may suspend or terminate your account (or any part thereof) or use of the Service and remove and discard any content within the Site and or Service, for any reason, including, without limitation, for lack of use or if CampUs Vitali believes that you have violated or acted inconsistently with the letter or spirit of these Terms of Service. Any suspected fraudulent, abusive, or illegal activity that may be grounds for termination of your use of Site and or Service, may be referred to appropriate law enforcement authorities. CampUs Vitali may also in its sole discretion and at any time discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service and or Site under any provision of this Terms of Service may be implemented without prior notice, and acknowledge and agree that CampUs Vitali may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Service. Further, you agree that CampUs Vitali will not be liable to you or any third party for any termination of your access to the Service.

 

User Disputes

You agree that you are solely responsible for your interactions with any other user in connection with the Service, Site and CampUs Vitali will have no liability or responsibility with respect thereto.

CampUs Vitali reserves the right but has no obligation, to become involved in any way it deems necessary with disputes between you and any other user of the Service.


Online Events and Otherwise


The information provided during Online Events and Otherwise is intended solely for educational purposes. While we strive to offer accurate and up-to-date content, the material presented is not a substitute for professional advice, diagnosis, or treatment. Participants are encouraged to seek the advice of qualified professionals regarding any specific concerns or questions they may have.


By attending Online Events and Otherwise, you acknowledge that the views and opinions expressed by the presenters are their own and do not necessarily reflect the views of any affiliated organizations. The organizers and presenters are not liable for any actions taken based on the information provided during this session.


Participation in Online Events and Otherwise does not create a professional-client relationship between attendees, presenters and or CUV. We encourage open discussion and sharing of experiences, but please remember that confidentiality cannot be guaranteed in a group setting. General

These Terms of Service constitute the entire agreement between you and CampUs Vitali and govern your use of the Service. You also may be subject to additional terms and conditions that may apply when you use affiliate or third-party services, third party content or third-party software. Notices to you may be made via either email, digital messages, meetings or regular mail. The Service may also provide notices to you of changes to these Terms of Service or other matters by displaying notices or links to notices generally on the Site.

 

Your Privacy

At CampUs Vitali, we respect the privacy of our users. For details please see our Privacy Policy. By using the Site and or Service, you consent to our collection and use of personal data as outlined therein.

Welcome to the website of CampUs Vitali  (“CampUs Vitali”, “CampUs”, “CUV”). CampUs Vitali allows parents or guardians to enroll minor learners or adult learners to enroll in on-line and/or face-to-face one-on-one and small-group sessions/ courses, as well as professionals and home-educating parents to enroll in professional and/or personal development Services and for educators. Also, professional coaches to cater those courses/ sessions (the Services and or Site). This Privacy Policy sets forth CampUs Vitali’s policy with respect to the information collected from visitors and users of CampUs Vitali’s Services and or Site.


Information We Collect

When you interact with us through our Services and or Site, we may collect information that, alone or in combination could be used to identify you (Personal Identifiable Information) and other information from you, as further described below:

Personal Identifiable Information That You Provide Through the Site: We collect Personal Identifiable Information from you when you provide such information, such as when you contact us with inquiries or register for a CampUs Vitali account to access the Services and or Site. We may collect the following information from you in order to provide our Services and or Products:

For Learners and or Parents/ Guardians:

  • Occupation and or hobbies
  • Credit card or other payment information;
  • Learner’s and or Parent's name;
  • Learner’s and or Parent's age or birthday;
  •  learner’s and or Parent's email address;
  • Video recordings of learner during courses/ sessions;
  • Your voluntarily provided profile picture
  • Information voluntarily provided in the ‘about me’ section of your profile;
  • Information voluntarily provided through reviews, discussions, electronic mail and otherwise and
  • Notes you provide to educators about yourself or the learner when enrolling.

For Educators & Other Professionals:

  • Name
  • Email address;
  • Phone number;
  • Address;
  • Credit card or other payment information;
  • Video recordings of you during a session;
  • Your voluntarily provided profile picture
  • Information voluntarily provided in the ‘about me’ section of your profile;
  • Information is voluntarily provided through reviews, discussions, electronic mail and otherwise and
  • Notes you provide when enrolling.

By providing us with Personal Identifiable Information, you are consenting to our use of it in accordance with this Privacy Policy. If you provide Personal Identifiable Information to our Services and or Site, you acknowledge and agree that such Personal Identifiable Information may be transferred from your current location to the offices and servers of CampUs Vitali and the authorized third parties referred to herein.

Other Information:

Passively Collected Data: When you interact with us through the Site, we receive and store certain data automatically. CampUs Vitali may store such passively collected data itself or such information may be included in databases owned and maintained by our affiliates, agents or service providers. We may use such information and pool it with other information to track, for example, the total number of visitors to our Sites, the number of visitors to each page of our website, and the domain names of our visitors’ Internet service providers.

In operating our Sites, we and third parties that provide certain functionality to CampUs Vitali may use a technology called “cookies.” A cookie is a piece of information that the computer that hosts our Services and or Site gives to your browser when you access the Site. Our cookies help provide additional functionality to our Services and or Site and help us analyze Site usage more accurately. On most web browsers, you will find a “help” section on the toolbar. Our Use of Your Personal Identifiable Information and Other Information

We use your information to:

  • Process your payment for the Services and or Site;
  • Send you emails or newsletters that you signed up for;
  • Improve the Services and or Site of CampUs Vitali; and
  • Analyze website usage.
  • CampUs Vitali Educators record their sessions and may use the recordings to improve their curriculum, courses/ sessions, and may provide the recording to parents and the participants in the course/ session to view. CampUs Vitali may also use Recordings to provide feedback to Educators, for customer support, marketing and for compliance purposes.
  • CampUs Vitali and its affiliates may use your Personal Identifiable Information to contact you in the future to tell you about Services and or Products we believe will be of interest to you. If we do so, each promotional communication we send you will contain instructions permitting you to “opt-out” of receiving future promotional information. In addition, if at any time you wish not to receive any future communications or you wish to have your name deleted from our mailing lists, please contact us at info@CampUsVitali.com. Please note that we will continue to contact you via email to respond to requests and provide our Services and or Products.

 


Storage

Your information, including Personal Identifiable Information, may be transferred to, and maintained on computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction. If you are located outside the United States and choose to provide information to us, please note that we transfer the data, including Personal Identifiable Information, to the United States and process it there.

Business Transfers: If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, your information may be transferred to a successor or affiliate alone or as part of that transaction along with other assets.

Vendors and Service Providers: We engage third-party vendors and service providers to perform certain functions on our behalf (such as payment processing). These third parties may have access to your Personal Identifiable Information for the purpose of helping us market, provide and/or improve the Services and or Site.

Legal Requirements: CampUs Vitali may disclose your Personal Identifiable Information if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) protect and defend the rights or property of CampUs Vitali, (iii) act in urgent circumstances to protect the personal safety of users of the Site or the public, or (iv) protect against legal liability.


Publicly Posted Information

You may be able to share Personal Identifiable Information with third parties, including with the general public, through the use of the Services and or Site.

User Profile: As a user of our Services and or Site, you will have a user profile that will be publicly available to our administration and Educators of the Services and or Site (the “User Profile”). You are not required to include any Personal Identifiable Information on your User Profile. However, you will have the option to include a variety of types of Personal Identifiable Information in your User Profile, which may include your first name, last name, biographical information, geographical location, and personal photograph.

We systematically monitor the content of information that is published on your user profile. We urge you to think carefully about what if any, Personal Identifiable Information you include in your User Profile.


Children

This section explains our information collection, disclosure, parental consent practices, and parental choice procedures with respect to information provided by children under the age of 18 (“Child” or “Children”). This policy is in accordance with U.S. Laws and Regulations, and the Jamaican Child Care and Protection Act. Collection: CampUs Vitali collects information about learners directly from Parents, who provide us with the Child’s first name, age, history of education, local time zone, additional notes for the Educators and otherwise. In addition, Children may share information about themselves during sessions. CampUs Vitali courses/ sessions take place over on-line videos in which video images and audio of the Children are recorded, and or face-to-face. No information is collected directly from Children until they are in the course session. Children cannot post Personal Identifiable Information publicly on CampUs Vitali website.

Use and Disclosure: CampUs Vitali shares the name, age, local time zone, and any notes Parents have provided about their Child to the Educator, in order to allow the Educator to be duly prepared and provide sessions/ courses. This information shall also be treated as part of the Parent’s Personal Identifiable Information and may be shared as described in the Disclosure section above for business transfers; to vendors and service providers; and to comply with legal requirements. Children may also share information about themselves with the Educator and the rest of their scholars during the Course/ Session voluntarily. While CampUs Vitali expects Educators and all other Users to abide by our standards of conduct, please note that we cannot control or monitor what personal information your Child shares with Educators and their scholars, nor what those third parties ultimately do with that information, and we disclaim all responsibility in that regard.

Recordings: As described above, CampUs Vitali records videos of learners and educators during courses/ sessions (Recordings). The Recordings are made available by CampUs Vitali to the Educator of the course/ session and may be shared with scholars of the course (and their Parents) to view (the Permitted Recipients). CampUs Vitali may also use Recordings to provide feedback to Educators, for customer support, marketing, and for compliance purposes. We utilize reasonable means to (i) limit the ability of Educators to create copies of the Recordings or to share the Recordings with anyone aside from Permitted Recipients, and also (ii) limit the ability of Permitted Recipients to download or re-share the Recordings. While we expect Educators and Permitted Recipients to abide by our standards of conduct, please note that we cannot control or monitor what such third parties ultimately do with Recordings, and disclaim all responsibility in that regard.

Parental Consent: CampUs Vitali obtains verifiable parental consent before collecting Personal Identifiable Information from your Child. CampUs Vitali requires that you provide your credit or debit card information to register your Child for and pay for a CampUs Vitali Course/ Session. If you do not consent, then we will not collect, use, or disclose any personal information about your Child, and your Child will not be allowed to use the Services and or Site in any way. If you are not using our Services and or Site for any other purposes and do not provide consent within a reasonable time from the date the direct notice was sent, we will also delete your online contact information from our records.

Parental Choices and Controls: At any time, you can refuse to permit us to collect further Personal Identifiable Information from your Children in association with your account, and can request that we delete from our records the Personal Identifiable Information we have collected in connection with that account. Please keep in mind that a request to delete records may lead to the termination of an account, membership, or other service. You may update your Child’s information by logging onto your account. You can contact CampUs Vitali to request access to, change, or delete your Child’s personal information by sending an email to us at info@CampUsVitali.com. A valid request to delete personal information will be accommodated within a reasonable time. In addition to the foregoing, we will exercise commercially reasonable efforts to delete personal information belonging to Children when it is no longer needed for the purpose for which it was collected.



Security

We take reasonable steps to protect the Personal Identifiable Information provided via the Services and or Site from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, the Internet cannot be guaranteed to be fully secure and we cannot ensure or warrant the security of any information you provide to us. We do not accept liability for disclosures beyond our reasonable control. You are also responsible for helping to protect the security of your account credentials. For instance, never give out your password, and safeguard your user name, password, and personal credentials when you are using the Services and or Site so that other people will not have access to your Personal Identifiable Information. Furthermore, you are responsible for maintaining the security of any personal computing device on which you utilize the Services and or Site.



Do Not Track

Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked. You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser. While we do not currently support Do Not Track signals, we treat the data of everyone who comes to our site in accordance with this Privacy Policy, whatever their Do Not Track setting.

 


Access and Accuracy; Correcting Personal Identifiable Information

You have the right to access the Personal Identifiable Information we hold about you in order to verify the Personal Identifiable Information we have collected with respect to you and to have a general account of our uses of that information. Upon receipt of your written request, we will provide you with a copy of your Personal Identifiable Information, although in certain limited circumstances, we may not be able to make all relevant information available to you, such as where that information also pertains to another user.
